Terms And Conditions
This rental agreement and Contract (the “ Agreement”) is a legally binding agreement made and entered into as of the Reservation Date written below by and between the undersigned person(s) or company (the “Guest”) and the undersigned owner, manager or agent (Rental Agent), pursuant to which the Guest has agreed to rent the residence described below (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.
OCCUPANCY
Guest agrees that no more than (5) persons shall be permitted on the Property (Lesa’s Retreat) at any time during the Rental Term, all of whom shall comply with the conditions and restriction imposed upon Guest under this Agreement.
CONDITION AND USE OF PROPERTY
The Property (Lesa’s Retreat) is provided in “as is” condition. Rental Agent/Owner shall use their best efforts to ensure the operation of all amenities in the Property, such as internet access, satellite or cable TV access, appliances as applicable. Rental Agent/Owner shall not be responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible.
Guests shall use the Property (Lesa’s Retreat) for residential purposes only and in a careful manner to prevent any damage or loss to the Property (Lesa’s Retreat) and keep the Property (Lesa’s Retreat) and keep the Property in clean and sanitary conditions at all times. Guests and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy or endanger or inconvenience neighbors, nor shall Guests use the Property (Lesa’s Retreat) for any immoral, offensive or unlawful purposes, nor violate any law, Broward County Ordinances, nor commit waste or nuisance on or about the Property (Lesa’s Retreat).
ASSIGNMENT OR SUBLEASE
Guest shall not assign or sublease the Property (Lesa’s Retreat) or permit the use of any portion of the Property by other person’s who are not family members or guests of the Guest and include within the number of and as permitted occupants under this Agreement.
RISK OF LOSS AND INDEMNIFICATION
Guest agrees that all personal property, personal affects and other items brought into the Property (Lesa’s Retreat) by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent/Owner shall not be responsible or liable for any reason whatsoever.
Guest hereby covenants and agrees to indemnify and hold harmless Owner, Rental Agent, Successors, Employees, Contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorney fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of guests due to any claims relating to distruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property (Lesa’s Retreat) and Guest expressly agrees to save and hold Rental Agent/Owner harmless in all such cases.
ENTRY AND INSPECTION
Owner/Rental Agent reserves the right to enter the Property at reasonable times and within reasonable advance notice for the purpose of inspecting the Property or showing the Property to prospective purchasers, renters or authorized persons. If Owner/Rental Agent has reason to belief that there is imminent danger to any person or property, Owner/Rental Agent may advance the Property (Lesa’s Retreat) without notice.
PETS, EMOTIONAL SUPPORT or SERVICE ANIMAL(s)
Pets are not allowed on the Property (Lesa’s Retreat). Emotional Support and Service Animals are allowed.
- Guest represents and affirms that it has properly licensed the Support or Service Animal if there is any general municipal or governmental licensing requirement for this type of animal and that you have inoculated the animal for rabies and other usual inoculations for this type of animal. TENANT further represents that the Support or Service Animal does not pose a direct threat of harm or danger to any persons and will not cause damage to the Property.
- Guest is responsible for the proper disposal of all animal waste. You acknowledge that if the animal violates the rules in this Addendum or theResidential Lease Agreement, the Rental Agent/Owner has the right to evict both you from the Property (Lesa’s Retreat), as well as exercise all other remedies available by law.
-Rental Agent/Owner will not charge any pet fees, pet rent or a security deposit for your Support or Service Animal. However, you will be liable for any damages that the animal may cause to the Property Lesa’s Retreat).
-Specifically in reference to a "service animal" as defined by Fla. Stat. 413.08(1)(d), you will comply with Fla. Stat. 413.08, et al. in its entirety. Therefore, if you misrepresent yourself as qualified to use a service animal, you agree that such conduct constitutes a material violation of the Residential Lease Agreement, Florida law and that we shall have all rights and remedies set forth in the Residential Lease Agreement, including the right to terminate your lease, seek breach of contract damages, eviction, attorney's fees and court costs to the extent allowed by law.
-Any Service or Support Animal(s) having offspring must be brought to the immediate attention of the Rental Agent/Owner.
-Guest acknowledges and agrees that all Indemnity, Liability and Hold Harmless provisions set forth in this Agreement, to which this section is expressly a part of, shall apply to all damages, injuries or harm resulting from or caused by the Service or Support Animal(s) to any person, animal, real or personal property.
SMOKING
Smoking is not allowed, in the property or on the premises.
UNAVAILABILITY OF PROPERTY
In the event the Property (Lesa’s Retreat) is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Rental Agent/Owner, Rental Agent/Owner will apply due diligence and good faith to locate a replacement property that equals the Property (Lesa’s Retreat) with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such a replacement property can not be found and made available, Rental Agent/Owner shall immediately return all payments made by Guest, whereupon this Agreement shall be terminated and Guest and Rental Agent/Owner shall have no further obligations or liabilities in any manner pertaining to this agreement.
ADDITIONAL TERMS TO THE RENTAL AGREEMENT
In addition to the standard terms included herein, Guest acknowledges and agrees that the following additional terms and conditions apply to the Guests rental of the property.
GENERAL PROVISIONS
This agreement contains the entire agreement between the parties with regard to the rental of the Property (Lesa’s Retreat), and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Rental Agent/Owner. This agreement shall be governed by the laws of the State Of Florida. The words “Rental Agent/Owner” and “Guest shall include their respective heirs, successors, representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. This Agreement may be signed in one or more counterparts, each of which is an original, but taken together constitute one in the same instrument. Execution of a digital signature shall be deemed a valid signature.
